The House Oversight Committee plans to withdraw its subpoena for former Special Counsel Robert Mueller, citing health issues that prevent him from testifying.
Subpoena Pulled
“House Oversight is withdrawing its subpoena for Mueller due to ‘health issues’ that prevent him from testifying,” journalist Paul Sperry reported on Monday.
Mueller, 80, was initially scheduled to appear for a deposition on September 2.
The subpoena was part of Chairman James Comer’s wider probe into the origins of the Trump-Russia investigation and other matters tied to what Republicans have called the “Russiagate hoax.”
Wider Subpoenas Issued
Earlier this month, Comer announced that the committee had issued subpoenas for several high-profile figures, including:

“These individuals must answer for their roles in one of the greatest political scandals in American history,” Comer said.
Mueller’s Reported Decline
According to Sperry, Mueller has been living in a memory-care facility for the past few years, raising questions about his ability to comply with congressional testimony.
“House Oversight Committee has subpoenaed Robert Mueller to appear … even though sources tell me Mueller has been living in a memory-care facility for the past few years,” Sperry wrote earlier this month.
Past Concerns Over Mueller’s Capacity
Mueller’s health had already raised concerns during his 2019 congressional testimony on the Russia investigation, where he appeared confused and repeatedly relied on his notes.
Critics at the time suggested he was serving as a figurehead, with Deputy Special Counsel Andrew Weissmann directing much of the probe behind the scenes.
