Criminal Charges Considered for Cassidy Hutchinson

GOP representatives have initiated a criminal referral to the Justice Department regarding Cassidy Hutchinson, a prominent witness for Democrats during the Jan. 6 investigation. This referral comes amidst allegations that she lied while testifying in 2022.

Rep. Barry Loudermilk of Georgia spearheaded this referral, claiming Hutchinson misrepresented vital details, including assertions that President Trump was aware of potential violence on January 6, yet proceeded with his plans.

The referral received backing from House Judiciary Chairman Jim Jordan, who is leading a comprehensive GOP review of the January 6 committee’s proceedings.

While such criminal referrals do not guarantee charges, they put Hutchinson back in the public eye, particularly as Republicans revisit the narrative surrounding January 6 and scrutinize the testimony of key witnesses.

At 29, Hutchinson served as a crucial aide to former White House Chief of Staff Mark Meadows during Trump’s first term. The January 6 committee characterized her as an essential source regarding the events leading to the Capitol riot and Trump’s reactions that day.

Her testimony drew intense criticism from Republicans, notably a sensational account claiming Trump reacted angrily when denied transport to the Capitol. This testimony included a dramatic secondhand account of him lunging for the wheel of his vehicle.

However, after her testimony, both a White House deputy and a Secret Service agent implicated in her story stated they did not recall the events as she described.

Hutchinson claimed her first lawyer advised her to minimize what she shared with investigators. This lawyer denied any unethical behavior, maintaining he acted properly.

After her dramatic public testimony in June 2022, Hutchinson switched legal representation, later providing further information during both closed-door and public sessions.

During the Biden administration, federal investigators also questioned Hutchinson as part of their larger inquiry into January 6, but no charges related to her testimony were filed, and her claims did not significantly impact the ensuing investigation led by Special Counsel Jack Smith.

Smith’s team assessed her accounts but found many of her allegations to be based on hearsay, restricting her potential as a trial witness.

Smith noted inconsistencies between what other witnesses recounted and Hutchinson’s statements, raising questions about her narrative’s reliability.

This referral signifies a shift in the GOP’s approach, seeking to move allegations against Hutchinson from political debate into the realm of possible legal consequences.
