On Tuesday, a New York Appeals court dismissed President Trump’s appeal to lift Judge Juan Merchan’s gag order.
The appeals court stated that Judge Merchan “properly weighed” Trump’s First Amendment rights.

“We find that Justice Merchan properly weighed petitioner’s First Amendment Rights against the court’s historical commitment to ensuring the fair administration of justice in criminal cases, and the right of persons related or tangentially related to the criminal proceedings from being free from threats, intimidation, harassment, and harm,” as per the order.
The New York appeals court stated that Trump’s public statements threatened the integrity of witness testimony:
“Justice Merchan properly determined that petitioner’s public statements posed a significant threat to the integrity of the testimony of witnesses and potential witnesses in this case as well.”
Merchan has severely restricted Trump’s First Amendment rights, leaving only Trump gagged. Meanwhile, Michael Cohen, a convicted perjurer and the key witness in the hush money trial, is free to use platforms like TikTok to criticize Trump without any restraint.

The judge’s daughter, Loren Merchan, is a left-leaning political activist involved with the Biden-Harris campaign. The media has portrayed 34-year-old Loren Merchan as if she were a child, aiming to undermine Trump’s freedom of speech protected by the First Amendment.
Loren Merchan’s company, Authentic Campaigns, Inc., has been funded with tens of millions of dollars by Democrats aiming to defeat Trump.
As reported by The New York Post, Loren Merchan assisted Democrats in raising $93 million based on her father’s case.
Earlier this month, Judge Merchan found Trump in contempt and fined him thousands of dollars for free speech violations.
He also threatened to jail Trump.
On Tuesday morning, Trump slammed Merchan’s gag order during remarks outside the New York courthouse.
“You ask me questions I’m not allowed to respond,” Trump told reporters Tuesday morning. “The gag order has to come off.”
