Swalwell’s Legal Threats Amid FBI Controversy Over Fang Fang

Rep. Eric Swalwell is escalating tensions with the FBI, indicating a legal battle may loom just ahead of the California elections.

His legal team has sent a cease-and-desist letter to FBI Director Kash Patel, alleging plans to release damaging documents related to Swalwell’s connections with suspected Chinese operative Christine “Fang Fang” Fang.

The lawyers claim, “Your attempt to release the file is a transparent attempt to smear him and undermine his campaign for Governor of California,” stating that doing so could expose the FBI to significant legal risks.

The situation intensified after The Washington Post reported that Patel is contemplating releasing records concerning Swalwell’s previous interactions with Fang, who is believed to have engaged in espionage efforts to cultivate ties with California Democrats.

Fang was involved in fundraising efforts for Swalwell’s 2014 House campaign and even placed an intern in his office. Swalwell severed ties with her in 2015, prompted by an FBI warning.

Despite the unfolding controversy, the Department of Justice declined to press charges, and the House Ethics Committee concluded its review in 2023 without finding wrongdoing on Swalwell’s part. He has consistently denied any misconduct.

Now, Swalwell’s legal team suggests the FBI might be crossing a line, referencing Justice Department guidelines that advise against overt investigative actions involving political candidates close to elections.

The timing of these events poses a challenge for Swalwell, as early voting in California’s gubernatorial primary begins in early May. He entered the race late last year, aiming for a strong finish.

In a recent CNN interview, Swalwell remarked, “It’s not lost on me that we’re 34 days until Californians start voting,” asserting he has led in polls and emphasizing the stakes involved.

Swalwell has been a fierce critic of former President Donald Trump, notably serving as an impeachment manager during Trump’s second impeachment proceedings.

He is also under scrutiny for separate allegations of mortgage fraud.

In the meantime, allies are expressing outrage over the FBI’s reported discussions about document releases, with Rep. Jamie Raskin condemning the notion of such actions close to an election.

“What the hell does that have to do with law enforcement?” Raskin questioned. “This is plain weaponization of the FBI for partisan political purposes.”
