Florida Democrat Faces Expulsion as Ethics Hearing Looms

Rep. Sheila Cherfilus-McCormick, a Democrat from Florida, is bracing for a critical ethics hearing that could jeopardize her House seat. Under federal indictment, she is facing potential prison time over serious allegations.

The proceedings on Thursday will see Cherfilus-McCormick testify before the House Ethics Committee in a public format that might lead to recommendations for her expulsion. The ethics issues align with her federal criminal case, which accuses her of misappropriating over $5 million in disaster relief funds to finance her congressional campaign and acquire luxury items, including a sizable diamond ring. She is also implicated in a straw-donor scheme and filing a false tax return.

Despite attempts to postpone the hearing, citing her ongoing legal challenges and loss of legal counsel, it’s uncertain if she will have representation during her testimony.

In a statement, Cherfilus-McCormick expressed her discontent with the committee’s decision to proceed, claiming it infringes upon her due process rights.

“I urge the Committee to follow its own precedents and uphold fairness and not allow this process to be driven by politics or numbers,” she stated. “I welcome the opportunity to set the record straight and challenge these inaccuracies, when I am legally able to do so.”

She has maintained her innocence and pleaded not guilty since the indictment in November 2025, and she has dismissed calls from Republicans for her resignation, which would circumvent the ethics review process.

The indictment details allegations against Trinity Health Care Services, co-owned by Cherfilus-McCormick and her brother, Edwin. They purportedly received a $5 million overpayment linked to a COVID-19 vaccination contract, which prosecutors allege went unreturned and was funneled through various accounts to hide its origins.

The Ethics Committee has compiled a 27-count list of alleged violations that will be discussed in the hearing.

Public hearings in the House Ethics Committee are rare, marking the first such instance for a lawmaker since 2010.

Rep. Greg Steube, a Florida Republican, intends to pursue an expulsion resolution regardless of the hearing’s outcome. Achieving expulsion necessitates a two-thirds majority vote in the House, meaning many Democrats would need to align with Republicans.

“You have a sitting member of Congress who’s allegedly stolen over $5 million in taxpayer funds,” Steube remarked. “She should resign immediately instead of prolonging this process.”

Steube further indicated that a bipartisan ethics recommendation would place Democrats in a difficult position.

“If the committee makes a bipartisan recommendation for expulsion, that puts the Democratic caucus in a very tight spot, as it would undermine their own members on the Ethics Committee,” he said.

As of now, House Democratic leaders have remained silent on endorsing expulsion. Last week, Cherfilus-McCormick appeared with other Democrats as House Minority Leader Hakeem Jeffries spoke during remarks related to a DHS shutdown dispute. When asked about the threats of expulsion, Jeffries responded with a curt, “next question.”

“I won’t prejudge the outcome,” House Democratic Conference Chairman Pete Aguilar stated. “I respect the work of the ethics committee.”

Republicans interpret this silence as significant.

“Leader Hakeem Jeffries talks tough on corruption, but goes silent when it involves one of his own,” NRCC spokesman Mike Marinella remarked.

Some Republicans have highlighted the swift expulsion of former Rep. George Santos in 2023, arguing it showcases a double standard.

“What happened to George was like a runaway freight train,” said Rep. Byron Donalds. “There was no opportunity for a thorough ethics process, while this case seems more measured.”

“This thoughtful approach should set a precedent moving forward,” Donalds added, emphasizing the need for careful deliberation before any judgments are made.
