2 Illegal Migrants Indicted in Shooting of Border Patrol Agent

Manhattan District Attorney Alvin Bragg Jr. and Homeland Security officials announced Tuesday the indictment of two illegal aliens involved in the attempted murder of a U.S. Border Patrol agent last month in New York City.

The suspects, Mora Nunez (21) and Christhian Aybar‑Berroa (22), are both illegally in the United States, and now face deportation after being charged in connection to the July 19 shooting that left an off-duty Border Patrol agent shot in the face and arm.

Suspect Entered Under Biden Admin, Ignored Court Date

Nunez entered through the Southern Border under President Biden, and was released in April 2023 due to “lack of detention space.” He was issued a notice to appear before an immigration judge — but never showed up.

Now, he faces charges including:

  • Attempted murder (1st and 2nd degree)

  • Assault

  • Robbery and attempted robbery

  • Criminal possession of a weapon

Nunez has a long rap sheet, including assault, grand larceny, kidnapping, and was wanted in Massachusetts for armed robbery.

Attack Caught on Camera

Just before midnight on July 19, the 42-year-old Border Patrol agent and a female companion were sitting along the Hudson River in Fort Washington Park, near the George Washington Bridge.

Surveillance video shows two suspects approaching on a moped. One jumps off, shoots the agent in the face, and is then wounded by the agent, who returned fire before the suspects fled.

The NYPD confirmed the agent sustained gunshot wounds to his face and arm.

Second Suspect Also Released Under Biden Border Policy

Aybar-Berroa also illegally entered through Texas in 2022 and was released due to lack of detention space. Since then, he has been:

  • Arrested eight times in NYC, mostly for scooter robberies

  • Never jailed long-term due to New York’s bail reform policies

  • Under a removal order since 2023

Authorities say Aybar-Berroa drove Nunez to a Harlem hospital after the shooting and tried to ditch bloody clothes used during the attack.

Outrage Grows as Crimes by Illegal Aliens Mount

The attack adds to a growing list of violent crimes committed by illegal aliens released under Biden’s border policies, especially in sanctuary cities like New York where criminal illegal immigrants are shielded from ICE enforcement.

Despite both suspects having multiple prior arrests and open warrants, they remained on U.S. streets—until they tried to kill a federal agent.
